All materials are sold AS-IS. There are absolutely no refunds for missing, inaccurate or damaged pieces. Colors, shades and textures may vary in appearance based upon device screen representation. Please attend Preview to determine your usage before deciding your bids.

You must bring your own help for any moving, carrying and loading of your items as well as an appropriate sized vehicle for transport. Any debris left behind (boxes, straps, plastic wrap, Styrofoam, etc.) will result in a Professional Waste Removal Services Fee charged to your account.

Large items can be palletized. The pallet fee is $75 and up per standard or custom pallet that is used. The pallet fee does not include the freight company charges. Small items can go FedEx for a minimum $5 handling fee. Fees are non-refundable and assessed once shipping is formally requested. NO refunds or chargebacks will be granted due to a lack of removal at the designated times. After the scheduled removal, items will be considered abandoned and you will be charged a removal fee for disposal of your items.

TYPES OF AUCTIONS (DEFINITIONS)

Absolute auction: An absolute auction, which is an auction or real or personal property to which all the following apply: (a) the property is to be sold to the highest bidder without reserve; (b) the auction does not require a minimum bid; (c) the auction does not require competing bids of any type by the seller or agent of the seller; (d) the seller of the property cannot withdraw the property from auction after the auction is opened and there is a public solicitation or calling of bids. Seller represents that he/she has a bona fide intention to transfer the property regardless of the price or identity of the high bidder.

Reserve auction: A reserve auction, which is an auction in which the seller or agent of the seller reserves the right to establish a stated minimum bid, the right to reject or accept any or all bids, or the right to withdraw the real or personal property at any time prior to the completion of the auction by the auctioneer.

BIDDER AGREEMENT / LEGAL CONTRACT

Submitting a bid is a contractual agreement to pay for winning bids, premium and tax at the end of the auction; we ask that you carefully and completely review the Terms & Details provided for each sale. These terms contain vital information per auction such as the auction site, whether or not shipping is available, what time and day inspection and removal will occur, our buyer's premium, and more. No cancellations, refunds or chargebacks will be allowed due to a failure to read the terms and details.

AUTHORIZATION HOLD FOR CARD VERIFICATION

Authorization for Credit Card Verification: As part of our online auction security measures, a temporary authorization holds of $1 to $3 may be placed on the credit card provided at registration. This hold is not a charge and is used solely to verify that the card on file is valid and has available funds. The authorization hold will automatically be released by your bank, typically immediately or within a few hours, depending on your financial institution's policies. No actual funds are withdrawn from your account. Please note that this verification may occur each time you place a bid or log in to bid to ensure continued validity of your payment method. This process helps maintain a secure and smooth auction experience for all participants. If you have any questions regarding this authorization, please contact your financial institution or our support team.

BUYER’S PREMIUM

A 17% buyer’s premium will be added to each purchase. If you bid $100.00, at checkout you will be charged $117.00.

PAYMENT

ALL CREDIT CARDS ON FILE WILL BE CHARGED AT THE END OF THE AUCTION. You must have available balance on your credit card for your online purchases. At the conclusion of the auction, you will be sent an email with a total of the items you won by 11am the next business day.

BIDDING ERRORS / SELF OUTBIDDING

Please be aware that many bidders routinely increase their own bid to price an item out of reach of other bidders. You should immediately review your bids once submitted. If you mistakenly increase your own bid, place your bidder number in the bid field, or make a typo you must immediately contact our office by email using the contact information on our website (we must have your request in writing). We will not reverse bids after the auction has closed, no exceptions.

STAGGERED & DYNAMIC CLOSING
━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━
Staggered closing: The online auction closes 2 items per minute. This feature will close the bidding on intervals. This feature works great with the auto-extend feature to closely emulate a 'live' auction.

Staggered Closing:

• Definition: Items in the auction close at regular intervals (e.g., 2 items per minute).
• Benefit: Prevents all items from closing at once, giving bidders more time to focus on multiple items.
• Example: Item 1 and 2 closes at 5:00 PM, Item 3 and 4 at 5:01 PM, and so on.

Dynamic closing: The closing time of an asset is automatically extended an additional 3 minutes whenever a bid is placed within the last 3 minutes of the asset's closing time.

Dynamic Closing:

• Definition: The auction time for an item is extended by a set amount (e.g., 3 minutes) if a bid is placed within the last few minutes of the item's scheduled close.
• Benefit: Prevents "sniping" (last-second bidding) and gives more time for fair bidding.
• Example: If a bid is placed at 4:58 PM, the closing time for that item extends to 5:03 PM.

NOTIFICATION RULES
━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━
Bid notification: If you have been outbid you will be notified by email ONLY UNTIL the last day of the auction --- starting at midnight EST the night before the ending of the auction notices will not sent. To quickly review your bids and see if you have won, you can utilize the 'review bids' feature. Items that they have been outbid on will be clearly marked.

Winning bidder notification: You will be contacted by email ONLY (you are responsible for checking your email) If you do not receive a paid email invoice by 11am the next day following the sale then you did not win any items at the online auction. If you feel you have won an item and have not received an email by 11am the next day you must notify us by email.

MISSING ITEM CLAIM PROCEDURE
━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━
In the event an item is not available for pickup, the buyer must notify our onsite staff and file a claim by replying to your original emailed invoice noting what was not available within 24 hours of the pickup date. After 24 hours, Fast Track Marketplace and buyer agrees that no adjustment or refund will be made.

SALES TAX / TAX EXEMPTION

Sales tax will be collected. Important tax-exempt status: If you are tax exempt, prior to the conclusion of the online auction you must DOWNLOAD and email a copy of the appropriate state’s tax-exempt form to neohio@fasttrackauction.com including your bidder number or upload it directly to your account from your user profile on our site, both subject to approval. BIDDER PRIVILEGE REVOCATION POLICY

We reserve the right to revoke or suspend bidder privileges at our sole discretion. This action may be taken for, but is not limited to, the following reasons: Failure to comply with our Terms and Conditions, Insufficient or non-verifiable funds, Chargebacks or payment disputes, Fraudulent bidding activity or suspected collusion, Abusive, disruptive, or inappropriate conduct, any behavior or activity deemed detrimental to the fairness, integrity, or operation of our auction platform. We are not obligated to provide prior notice or explanation before revoking bidding privileges. By participating in our auctions, bidders acknowledge and accept this policy.

CAUTION & PHOTO NOTICE

Caution: For demonstration purposes various equipment may be joined. Do not assume a lot consists of more than one item simply because they are connected or pictured together. Please inspect the lot numbers and read the descriptions.

WARRANTY & CONDITION OF ITEMS

REMOVAL FAILURE / ABANDONMENT / STORAGE COSTS

Bidders are responsible for their own removal. Any item NOT picked up by the set time will be considered abandoned. Removal shall be at the expense, liability, and risk of the purchaser. Purchases will be released upon presentation of a paid email receipt. Please ensure that movers or anyone picking up items on your behalf have the credit card used for purchase and the ID of the purchaser with them as well as the paid receipt at the pickup location. No invoices over $1000 will be released without these conditions being met. Important: Fast Track Marketplace will have the option of reselling, removing, storing or abandoning, at the expense and risk of the purchaser, items not paid for and/or removed within the specific time. The buyer agrees to pay all deficiencies, legal, collection; transportation and storage expenses associated with delinquent accounts or abandoned items.

Fast Track Marketplace reserves the right to add or remove items from the auction; split or combine lots; add minimum bids or reserve prices; cancel, suspend, extend or reschedule an individual item and or auction event; make changes to the auction closing times or inspection and or removal times.

DISPUTE RESOLUTION

Any controversy or claim arising out of or relating to this contract and/or agreement, or breach thereof, shall be settled by arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association, and judgments upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Venue will be Lorain County, Ohio.

STAFF BIDDING

Staff bidding: Please note that staff bidding is allowed in this auction. Anyone from the staff is welcome to bid on and purchase items for the highest bid.

LIABILITY LIMITATION

Liability: Fast Track Marketplace and Seller’s liability shall be limited to the refund of bidders purchase price.
