Terms of Auction

Auction closing date: This auction closes Sunday, September 7, 2025 @ 9:00pm EST (8:00pm CT).  The bidding closes the first 2 items at 9:00pm then closes 2 items per minute thereafter to the last item in catalog order.

Inspection: Tuesdays from 10:00am - 4:00pm EST ONLY 

Removal: Thursday September 11, 2025 & Friday September 12, 2025 10:00am - 4:00pm EST TIME ONLY

The ID of the purchaser and the Credit Card used for this purchase are required for Invoices over 1k! THE NAME ON THE CREDIT CARD USED FOR THIS PURCHASE AND THE NAME ON THE ID MUST MATCH!

 If you cannot bring the ID and the Credit Card, you must contact our office @ 440-653-9321 or neohio@fasttrackauction.com to make other arrangements.  No invoices over $1000 will be released without this condition being met.  No exceptions!

SHIPPING IS AVAILABLE FOR THIS AUCTION

Large items can be palletized. The pallet fee is $50 and up per standard or custom pallet that is used. The pallet fee does not include the freight company charges. This is an ONLINE ONLY AUCTION PLEASE DO NOT BID IF YOU ARE NOT ABLE TO PICK UP YOUR ITEMS during the scheduled removal times! NO refunds or chargebacks will be granted due to a lack of removal at the designated times. After the scheduled removal, items will be considered abandoned and you will be charged a removal fee for disposal of your items.

Types of auctions:

·       Absolute auction: An absolute auction, which is an auction or real or personal property to which all the following apply: (a) the property is to be sold to the highest bidder without reserve; (b) the auction does not require a minimum bid; (c) the auction does not require competing bids of any type by the seller or agent of the seller; (d) the seller of the property cannot withdraw the property from auction after the auction is opened and there is a public solicitation or calling of bids. Seller represents that he/she has a bona fide intention to transfer the property regardless of the price or identity of the high bidder. 

·       Reserve auction: A reserve auction, which is an auction in which the seller or agent of the seller reserves the right to establish a stated minimum bid, the right to reject or accept any or all bids, or the right to withdraw the real or personal property at any time prior to the completion of the auction by the auctioneer.

Submitting a bid is a contractual agreement to pay for winning bids, premium and tax at the end of the auction; we ask that you carefully and completely review the Terms & Details provided for each sale. These terms contain vital information per auction such as the auction site, whether or not shipping is available, what time and day inspection and removal will occur, our buyer's premium, and more. No cancellations, refunds or chargebacks will be allowed due to a failure to read the terms and details. 

Authorization For Credit Card Verification: As part of our online auction security measures, a temporary authorization hold of $1 to $3 may be placed on the credit card provided at registration. This hold is not a charge and is used solely to verify that the card on file is valid and has available funds. The authorization hold will automatically be released by your bank, typically immediately or within a few hours, depending on your financial institution's policies. No actual funds are withdrawn from your account. Please note that this verification may occur each time you place a bid or log in to bid to ensure continued validity of your payment method. This process helps maintain a secure and smooth auction experience for all participants. If you have any questions regarding this authorization, please contact your financial institution or our support team.

Buyer’s premium: A 17% buyer’s premium will be added to each purchase. If you bid $100.00, at checkout you will be charged $117.00.

Payment: ALL CREDIT CARDS ON FILE WILL BE CHARGED AT THE END OF THE AUCTION.  You must have available balance on your credit card for your online purchases. At the conclusion of the auction, you will be sent an email with a total of the items you won by 11am the next business day.

Increasing your own bid/bidding errors: Please be aware that many bidders routinely increase their own bid to price an item out of reach of other bidders. You should immediately review your bids once submitted. If you mistakenly increase your own bid, place your bidder number in the bid field, or make a typo you must immediately contact our office by email using the contact information on our website (we must have your request in writing). We will not reverse bids after the auction has closed, no exceptions.

Staggered closing: The online auction closes 2 items per minute. This feature will close the bidding on intervals. This feature works great with the auto-extend feature to closely emulate a 'live' auction.

Dynamic closing: The closing time of an asset is automatically extended an additional 3 minutes whenever a bid is placed within the last 3 minutes of the asset's closing time.

Bid notification: If you have been outbid you will be notified by email ONLY UNTIL the last day of the auction --- starting at midnight EST the night before the ending of the auction notices will not sent.  To quickly review your bids and see if you have won, you can utilize the 'review bids' feature. Items that they have been outbid on will be clearly marked.

Winning bidder notification: You will be contacted by email ONLY (you are responsible for checking your email) If you do not receive a paid email invoice by 11am the next day following the sale then you did not win any items at the online auction.  If you feel you have won an item and have not received an email by 11am the next day you must notify us by email.

In the event an item is not available for pickup, the buyer must notify our onsite staff and file a claim by replying to your original emailed invoice noting what was not available within 24 hours of the pickup date. After 24 hours, Fast Track Marketplace and buyer agrees that no adjustment or refund will be made.

Sales tax: Sales tax will be collected.

Important tax-exempt status: If you are tax exempt, prior to the conclusion of the online auction you must DOWNLOAD and email a copy of the appropriate state’s tax-exempt form to neohio@fasttrackauction.com including your bidder number or upload it directly to your account from your user profile on our site, both subject to approval.  If your form is rejected, you will have to apply to the state for a refund.  If you have any questions, contact the Elyria office at 440.653.9321 or email neohio@fasttrackauction.com.

Caution: For demonstration purposes various equipment may be joined. Do not assume a lot consists of more than one item simply because they are connected or pictured together. Please inspect the lot numbers and read the descriptions.

Catalog inaccuracies: You are bidding on the described item not the photo. Occasionally the wrong photo is displayed always read the item description.

Warranty & the condition of items sold: All items are sold "AS IS, WHERE IS”, with NO WARRANTY expressed or implied by the lot number affixed to the item. This sale is to the business community as "equipment" & "inventory" without any implied or expressed warranty. Descriptions are believed to be accurate but not guaranteed. When you are not certain of the condition of an item use preview to inspect your items and please bid accordingly. You are bidding on the described item not the photo.

Bidders are responsible for their own removal. Any item NOT picked up by the set time will be considered abandoned. Removal shall be at the expense, liability, and risk of the purchaser. Purchases will be released upon presentation of a paid email receipt. Please ensure that movers or anyone picking up items on your behalf have the credit card used for purchase and the ID of the purchaser with them as well as the paid receipt at the pickup location.  No invoices over $1000 will be released without these conditions being met.  If you cannot provide these documents, please contact our office at 440-653-9321 or email neohio@fasttrackauction.com to make other arrangements.

Important: Fast Track Marketplace will have the option of reselling, removing, storing or abandoning, at the expense and risk of the purchaser, items not paid for and/or removed within the specific time. The buyer agrees to pay all deficiencies, legal, collection; transportation and storage expenses associated with delinquent accounts or abandoned items.

Bidder Privilege Revocation Policy : We reserve the right to revoke or suspend bidder privileges at our sole discretion. This action may be taken for, but is not limited to, the following reasons:

Failure to comply with our Terms and Conditions, Insufficient or non-verifiable funds, Chargebacks or payment disputes, Fraudulent bidding activity or suspected collusion, Abusive, disruptive, or inappropriate conduct, Any behavior or activity deemed detrimental to the fairness, integrity, or operation of our auction platform. We are not obligated to provide prior notice or explanation before revoking bidding privileges. By participating in our auctions, bidders acknowledge and accept this policy.

 Choose wisely: We want everyone to get a good deal and most will. However, when you bid on the wrong item or decide an item is not suited for your intended use, our clients are not willing to assume the cost of your mistakes. When in doubt about condition, completeness or suitability for intended use, please bid accordingly.

Fast Track Marketplace reserves the right to add or remove items from the auction; split or combine lots; add minimum bids or reserve prices; cancel, suspend, extend or reschedule an individual item and or auction event; make changes to the auction closing times or inspection and or removal times.

Any controversy or claim arising out of or relating to this contract and/or agreement, or breach thereof, shall be settled by arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association, and judgments upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Venue will be Lorain County, Ohio.

Staff bidding: Please note that staff bidding is allowed in this auction.  Anyone from the staff is welcome to bid on and purchase items for the highest bid.

Liability: Fast Track Marketplace and Seller’s liability shall be limited to the refund of bidders purchase price.

Limitations: The above-stated Conditions of Sale cannot be altered except in writing by Fast Track Marketplace.

Licensure: Fast Track Marketplace is an Auction Firm that is licensed by the Ohio Department of Agriculture and bonded in favor of the state.
